License Agreement

The following license agreement (“Agreement”) applies to all house plan purchases made from Home Plan Central, Inc. and through its website: www.homeplancentral.com. Please read this legally binding contract thoroughly before making your purchase.

This Agreement is a legally binding contract between (1) the purchaser of the license for the house plan and, if applicable, said purchaser’s company (collectively: “Licensee”) and (2) Home Plan Central, Inc. ("HPC"). This Agreement states the terms and conditions under which the Licensee is permitted to reproduce and modify house plans and to construct a house using plans purchased from HPC.

1. Grant of License. HPC grants the Licensee a non-exclusive, non-transferable, non-assignable License to use HPC’s house plans as defined in this Agreement. Only HPC has the right to grant a license to its intellectual property. HPC grants this license to the Licensee only and not to Licensee’s independent designers, sub-contractors, business associates, family members, or anyone else.

2. License Conditional on Payment. This license is conditional on the full and timely payment of all monies from the Licensee to HPC. The License is only granted when said payments have been received by HPC. If Licensee fails to provide full and timely payments to HPC, Licensee’s license to the selected HPC house plan may be revoked or withheld by HPC.

3. Any violation of any of the terms, conditions, and restrictions of this Agreement by Licensee shall cause the license to be immediately revoked, without notice from HPC.

4. Copyright. By purchasing a house plan, The Licensee agrees that all HPC plans, drawings, photographs, and renderings, and any derivative works by HPC or others are protected under federal copyright law. Copyright owners can seek full remedies for infringement under the copyright statutes including statutory damages of up to $150,000 per infringement plus litigation costs and attorneys' fees. All parties including the Licensee, independent designers, draftsmen, owners, builders, realtors, and reprographics shops are responsible if they were involved in violation of a copyright.

No portion of any HPC plan, drawing, photograph, or rendering may be reproduced, stored, or transmitted in any form and by any means, electronic, mechanical, reprographic, or other than as defined by the following:

“Single-use PDF” license: Following the purchase of a “single-use PDF” license for a house plan from HPC, the Licensee may build one (1) house as originally designed by HPC from said plan. The Licensee may also print as many paper sets as needed for the construction of one house.

“Multiuse PDF” license: Following the purchase of a “multiuse PDF” license for a house plan from HPC, the Licensee may build an unlimited number of houses as originally designed by HPC from said plan.

“Multiuse PDF + CAD” license: Following the purchase of a “multiuse PDF + CAD” license for a house plan from HPC, the Licensee and his independent designer may make modifications to HPC’s design. HPC takes no responsibility for the derivative design. The Licensee accepts responsibility and liability for all modifications made. The HPC name, logo, and website shall not be used or represented on the plans or on any documents associated with the derivative design or construction of the house. The Licensee may build an unlimited number of houses based on the original design by HPC. However, HPC maintains the copyright for any derivative works by other designers based on HPC’s original designs.

For all licenses: The Licensee may print as many paper sets as needed for the construction of one house. The Licensee may loan printed copies or digital files of home plans to third parties as needed to assist in the construction of a single residence, as licensed in this agreement. All such loaned, printed copies and files must be retrieved or destroyed except for the owner’s reference set, after such assistance has been completed.

5. Corrections. Although HPC makes every effort to ensure the accuracy of its plan information, HPC reserves the right to make corrections on its drawings if changes occur. Also, photographed homes may have been modified from their original construction documents to suit the homeowner's preferences, and do not necessarily represent the HPC design.

6. All house plans ordered through HPC are provided as is. HPC disclaims all warranties, express or implied, including warranties of merchantability or fitness for a particular purpose.

HPC is not liable for incidental, special, consequential, or indirect damages of any kind, including, but not limited to, loss of anticipated profits, business opportunity or other economic loss arising out of plans received from HPC (even if HPC has been advised of the possibility of such damage), defects in construction or design and damage caused thereby, the success of the permit submittal process, or the loss or destruction of a digital or physical copy of a licensed HPC plan.

In the event that any liability is imposed on HPC, HPC’s liability to Licensee or to any third party shall not exceed the price paid for the HPC house plan.

House plans may not be returned for credit and/or a refund under any circumstances.

7. Disputes. Any dispute over the terms of this Agreement, compliance or non-compliance with such terms, or in any issue arising from the use of the license or use of any portion of an HPC plan, must be brought in state or federal court in Coeur d’Alene, Idaho. The Licensee hereby agrees to the jurisdiction of such courts over himself and his company (if applicable). HPC reserves the right to take action against any Licensee for use that does not conform to the terms of this Agreement, infringes any HPC intellectual property or other right, or violates other applicable law.

By buying any house plans from HPC, you signify your agreement to the above terms and conditions.
